1 Introduction
You must be at least 19 years of age (the age of majority in British Columbia) to make a booking or place an order. Guests under 19 may take part in events and upload photos only as described in Section 8.
2 General Overview and Services
3 Use of the Website
- scrape, copy or harvest content or data from the Website by automated means;
- interfere with or disrupt the Website, its servers or its security features;
- attempt to gain unauthorized access to any part of the Website, accounts or systems;
- use the Website for any unlawful purpose or in a way that infringes the rights of others.
We may suspend or restrict access to the Website at any time, including for maintenance or if we believe these Terms have been breached.
4 Event Bookings, Deposits, and Payments
- Service agreement: Event bookings are governed by these Terms and by the event service agreement or proposal we provide to you (the “Service Agreement”). If the Service Agreement conflicts with these Terms, the Service Agreement prevails for that booking.
- Retainers and deposits: Your event date is secured only when we receive the deposit or retainer set out in your Service Agreement. Except as stated in Section 10 or required by law, deposits are non-refundable.
- Payment terms: The outstanding balance is due 2 business days before the date of the event, unless the Service Agreement says otherwise.
- Late payment: If a balance is overdue, we may withhold or cancel services, and we may charge interest on the overdue amount at 1.5% per month (18% per year), calculated from the due date until paid.
- Payment methods and chargebacks: We accept the payment methods shown on the Website or in your proposal. Payments are processed by third-party payment providers. If you dispute a charge with your card issuer without first contacting us, we may provide the issuer with records of your booking, the services delivered and these Terms.
- Currency and taxes: All prices on the Website or in proposals are in Canadian Dollars (CAD) and are subject to applicable federal and provincial taxes (GST/PST), unless stated otherwise.
5 Event Requirements and Client Responsibilities
- Venue access and permissions: Obtaining any permission needed from the venue for our setup, equipment and operation, and giving us access at the agreed setup and teardown times.
- Space and power: Providing a suitable table or stall area and access to a standard power outlet, and, for outdoor events, a sheltered, level area protected from rain, wind and direct sun.
- Connectivity: Ensuring there is reliable wifi or mobile data at the venue so guests can use the upload portal. We are not responsible for delays or missed prints caused by poor or unavailable connectivity at the venue. Where we offer an offline option, we will tell you in your Service Agreement.
- Guest conduct: Informing guests of how the upload portal works and making sure guests treat our equipment with care.
- Package limits: Each package includes the number of magnets, hours of service and features stated in your Service Agreement. Additional magnets, additional hours and travel outside our standard service area are charged at the rates in your Service Agreement or as quoted by us in writing before the event.
6 Retail and Online Orders
- Pricing and Orders: Prices are shown on the Website at checkout and include or exclude taxes and shipping as shown at that time. An order is accepted when we send you an order confirmation. We may decline or cancel an order, for example because of a pricing error, a content issue under Section 8, or unavailability, and if we do, we will refund any amount you have paid for it.
- Production Time: Custom orders are produced after we receive your order and photo. Estimated production times are shown at checkout or in your confirmation. These are estimates, not guarantees.
- Pickup and Delivery: Orders may be picked up at event from Magnet Booth or delivered at your event as arranged. Orders are shipped within Canada by Canada Post. Shipping costs and estimated delivery times are shown at checkout. Risk of loss passes to you when the carrier delivers the order to the address you provided. You are responsible for giving us a correct address and contact information.
- Damaged or Incorrect items: Please inspect your order on receipt. If your order arrives damaged, defective, or is not what you ordered, contact us at events@magnetbooth.ca within 7 days of receiving it, with your order number and a photo of the problem. We will reprint or replace the item, or refund you, at our choice.
- Returns and refunds: Because our products are made to order from your photos, we do not accept returns or give refunds for change of mind, or for orders that match the photo and options you approved or submitted. This does not limit any rights you have under applicable consumer protection law.
- Approved Refunds: Approved refunds are issued to the original payment method within 10-15 business days.
7 Photo Quality
The quality of a printed magnet depends on the photo you upload. Please note that:
- Low-resolution, blurry, dark or heavily compressed images may print with visible loss of quality.
- Colours may look slightly different in print than on a screen, and small variations between prints are normal.
- Photos may be cropped or resized to fit the magnet size and frame, and edges may be trimmed.
- We show a preview and ask you to confirm the crop before printing. / we will do our best to place the image sensibly but cannot guarantee a particular crop.
- We are not responsible for quality issues caused by the file you provide, or for errors in photos you approved.
If a print has a defect that comes from our printing process and not from your photo, we will reprint it as described in Section 6.
8 Uploaded Photos & User Content
- Ownership: You keep full ownership of the original photo.
- License to print: You grant Magnet Booth a temporary, non-exclusive, royalty-free license to store, process, resize, crop, frame and print your submitted image, solely to produce physical photo magnets for you and your event hosts and guests, and to provide related customer service.
- Your confirmation: You confirm that you own the photo or have permission to use and print it, and that anyone clearly shown in it has been told about and is comfortable with the use described in these Terms.
- Photos of minors: Photos of anyone under 19 may be uploaded only by, or with the permission of, a parent or legal guardian. Where an event host has told us that guests are children, the host is responsible for obtaining that permission.
- Content restrictions: You agree not to upload images that are unlawful, obscene, sexually explicit, defamatory, threatening, hateful, infringing on third-party copyrights, trademarks or privacy, or otherwise objectionable. We may decline to print any image that breaks these standards, and for repeated or serious violations we may remove content and refuse further service, without a refund for the affected order.
- Guest uploads at events: At events, guests upload their own photos. We do not review every upload in advance and are not responsible for the content that guests choose to submit. The event host is responsible for guest conduct at their event.
- Responsibility for claims: You agree to compensate Magnet Booth and SRN Solutions Inc. for losses, claims and reasonable legal costs that arise because you uploaded content you did not have the right to use, or because your content broke these Terms or the law.
- Retention and deletion: We keep uploaded photos only as long as needed to produce and deliver your order and handle any problems with it, and we delete them within 90 days after the event or order. You may ask us to delete your photos sooner by emailing events@magnetbooth.ca; we will do so unless we need to keep them to meet a legal obligation or resolve a dispute.
9 Photo Display & Marketing Usage
- Event Privacy: Photos uploaded by guests at a private event are used only for printing magnets at that event or for that order.
- Promotional Use: Magnet Booth will not publicly display or use guest photos for marketing, social media or website portfolio purposes without the express, documented consent of the event organizer or the individual who owns the photo. Where we offer it, that consent is given through an opt-in choice on the booking or order form.
- Withdrawing Consent: You may withdraw your consent at any time by emailing events@magnetbooth.ca, and we will stop using the photo for future promotion and remove it from our channels within a reasonable time. We cannot recall material that has already been shared by others.
10 Cancellation & Rescheduling
Client Cancellations: Deposit refunds and cancellation terms are governed by the specific service contract signed upon booking. If your Service Agreement does not set out cancellation terms, the following apply:
- More than 15 days before the event: we keep the deposit and refund any other amounts paid.
- 15 days or fewer before the event: no refund of amounts paid, and any unpaid balance remains payable.
- Rescheduling: You may request a new date up to 2 times at no extra charge if you ask at least 15 days before the event, subject to our availability. Later requests, or further changes, may be treated as a cancellation or incur a rescheduling fee of $100.
- Our cancellations: If we have to cancel an event for reasons within our control, we will offer you a new date or a full refund of everything you paid for that event.
- Retail orders: Cancellations of online orders are covered in Section 6.
11 Force Majeure and Weather
12 Equipment, Safety and Product Safety
- Equipment: Clients and guests must treat our equipment with care. You may be charged for loss of or damage to our equipment caused by you or your guests, at repair or replacement cost.
- Right to refuse or stop service: We may refuse, pause or end service at an event where conditions are unsafe, our staff or equipment are at risk, or guests are behaving abusively. In that case no refund is due for the part of the service that could not safely be delivered.
- Product safety: Photo magnets contain magnetic material and small parts. They are not toys and are not suitable for young children, who may choke on or swallow them. Swallowing more than one magnet can cause serious injury and needs urgent medical attention. Keep magnets away from pacemakers, implanted medical devices, credit cards and other magnetic or electronic items.
